A&W Concentrate Co. and Keurig Dr. Pepper Inc. have agreed to a $15 million class action settlement to address claims that they falsely advertised their root beer and cream soda as containing real vanilla when they used artificial vanilla flavoring called ethyl vanillin.
This settlement is for U.S. residents who purchased A&W Root beer or Cream Soda products with the label “made with aged vanilla” between February 7th, 2016, and June 2nd, 2023, for personal use and not for resale.
These are the A&W products that are covered by this settlement: A&W Root Beer (Regular), A&W Root Beer (Diet), A&W Root Beer (Zero Sugar), A&W Root Beer (Ten), A&W Cream Soda (Regular), A&W Cream Soda (Diet), A&W Cream Soda (Zero Sugar)
If you’re eligible to be part of the class, you don’t need proof of purchase to participate in the settlement. There are three tiers for claiming refunds based on the number of products you purchased:
- Tier 1: If you submit a claim without proof of purchase, you’ll receive $5.50 per household.
- Tier 2: If you file a claim with and without proof of purchase, you’ll get a minimum of $5.50, plus an additional $0.50 unit purchased (up to 39 units supported by proof of purchase) for a total of up to $25 per household.
- Tier 3: If you submit all claims with proof of purchase, you’ll receive a minimum of $5.50 and $0.50 per unit for every unit over 11 units purchased, up to 50 units for $25.
Each household can file only one claim, regardless of the number of people living there, and individual payment amounts may be reduced if many valid claims are submitted.
Dates to Remember!
The deadline to request exclusion from or object to the settlement is August 28th, 2023, and the final hearing is set for September 19th, 2023. To receive your refund, you must submit a claim form by October 18th, 2023.
Remember, no proof of purchase is required to be part of this settlement, so if you qualify, don’t miss the chance to claim your refund!
